Terms and conditions for online learning content
Learning platform terms of use
Learning Locker is a course delivery platform made available to you under licence by David Lloyd Leisure Limited, company number 01516226 registered in England and Wales with registered office at The Hangar, Mosquito Way, Hatfield AL10 9AX (“we/us”). Your use of the Learning Locker website is subject to these terms and conditions.
Password security
When you register with Learning Locker you will be required to set a password. Your password is personal to you, and you must not permit anyone else to use it. You must take reasonable steps to protect your password from loss or misuse.
Use of course material
“Course Material” means all content we make available to you on the Learning Locker platform whether in text, audio, video, or any other format.
The Course Material is subject to copyright. On payment of the appropriate fee, we will grant you a limited, personal, non-transferrable licence to use the Course Material in accordance with these terms.
You may not copy, modify, distribute, transmit, display, reproduce, publish, transfer, sell or license the Course Material nor use it to create derivative works in any form.
“Featured Programmes” means the group exercise classes (such as “Ign1te”) which are the subject of the Course Material.
You may use the Course Material solely in preparation for an assessment in connection with your application to deliver the Featured Programmes at David Lloyd clubs.
“Downloadable Course Material” means choreography notes, music and any other material in electronic format which is available for you to download from Learning Locker. You may use the Downloadable Course Material solely in connection with your application to deliver the Featured Programmes at David Lloyd clubs.
Limited warranty
We do not guarantee that the Course Material is fit for any particular purpose. We do not guarantee to contract with you to deliver any of the Featured Programmes regardless of whether you pass or fail any assessment.
We do not guarantee that all course material will be available at all times or that the website will be available continuously. We may have to take the website offline for essential maintenance or security reasons. If we do so, we will try to give reasonable advance notice on the website.
You will need an internet connection and suitable hardware and software to access Learning Locker. You are responsible for ensuring that your connection, hardware and software are capable of viewing the website content.
Privacy notice
Personal data we collect
We will collect your name and sufficient contact details to identify you as an account holder. We will record details of the courses and assessments you have you have attempted. Our payment processor will collect your payment card and transaction details.
Purpose of processing
We process your data on the basis of our contractual obligation to deliver the training you have requested, to collect payment, and to keep a record of your achievement.
Retention policy
We will retain your details for 12 months after you close your Learning Locker account or your accreditation expires, whichever is later.
Data subject rights
You have the right to make a request for a copy of the personal data that we keep about you (in a portable electronic format) or to correct the details that we hold about you. Please contact us by email at DLProducttraining@davidlloyd.co.uk. We will respond within one month.
You have the right to ask us to erase your personal data under certain circumstances. You have the right to ask us to stop processing your personal data where the processing is based on our legitimate interests. If we believe we have a legitimate reason for processing your personal information including for the defence of any legal claims we may decline your request.
Under certain circumstances, for example if we decline your request to stop processing, you have the right to ask us to restrict the processing of your personal data.
Fees and Payment
The fee for each module is set out on the Learning Locker website. Fees are payable in advance by credit or debit card.
Your enrolment is accepted on receipt of payment. You will be sent a unique link to access the relevant Course Content. The link will be available for 30 days from the date of booking, after which it will expire, and the Course Content will no longer be available.
All prices include VAT where applicable.
Cancellation and refund policy
You can cancel a course and receive a full refund within 14 days of enrolling provided that you have not accessed the relevant Course Material. If you have already accessed the Course Material, no refund will be given. To cancel, you must contact us in writing by post or by email to DLProducttraining@davidlloyd.co.uk. We will do our best to refund any fees due to you within 14 days.
We may cancel a course: if it is under-subscribed; due to lack of available trainers; or for other reasons. If we have to cancel a course that you have booked, we will try to give you at least 7 days’ notice in advance and we will refund or credit any fees you have paid.
Complaints
If you are not satisfied with the service we provide, please contact us in writing by post or by email at DLProducttraining@davidlloyd.co.uk. We will endeavour to respond within 10 business days.
