Purpose

This Appeals Procedure applies to any learner who wishes to appeal against their assessment decision and protects their rights to appeal against an assessment decision that they believe has been made unfairly.

• All learners are assessed against our published assessment criteria.

• All learners who agree to take our assessments will have received:

o full written and verbal assessment instructions

o copies of the assessment criteria

o support to prepare for their assessment.

• All assessments will be conducted by assessors who:

o hold or are working towards nationally recognised qualifications (e.g. Education and Training Qualification, Assessor Qualification and where relevant Internal Quality Assurer Qualification)

o have relevant industry qualifications and experience in the discipline they are assessing

o participate in regular internal standardisation activities for the courses they assess.

• A learner who wishes to appeal against an assessment decision may do so, following the Assessment Appeals Procedure outlined in this document.

 

Grounds for Appeal

Candidates may appeal if it is believed that:

• The assessor was inappropriate in their administration of the assessment.

• The learner was not given a fair opportunity to provide evidence to be assessed against the assessment criteria.

• A marking decision was unfair.

• An unavoidable circumstance arose, which was outside the control of the learner, and resulted in the learner being unable to meet the assessment criteria as stated.

Appeals Policy Flow

 

Any appeal against an assessment decision should adhere to this process:

Step 1: Informal appeal

• In circumstances where a learner does not agree with the decisions of the assessor, the learner should raise the issue verbally with the assessor during or at the end of an assessment feedback session or in writing within 5 working days of the assessment.

• The assessor must notify the relevant Product Head and the IQA of the appeal and copy them in on all further communication with the learner. They may ask the product head and IQA for support when re-assessing the evidence and drafting their feedback.

• The assessor must reconsider the reasons underpinning the decision and provide clear feedback to explain their assessment decision in relation to the assessment criteria. This should be provided in writing by the assessor within 5 working days.

 

Step 2: Formal appeal

• If the learner is still not satisfied with the explanation provided, they should complete the Appeal Form and send it by email to DLProductTraining@davidlloyd.co.uk or by post to the Head of Fitness Products and Programming, Club Support, David Lloyd Clubs, The Hangar, Hatfield AL10 1AX.

• The learner should include a link to the assessment video, assessment paperwork and any additional supporting evidence in support of the appeal.

• On receiving the completed Appeal Form, we will confirm receipt within 10 days.

• An independent assessor/internal quality assurer will review the appeal and respond within 21 days.

• Additional evidence may be requested to enable a full and fair decision to be made by the independent assessor/internal quality assurer.

Step 3: Appeal hearing

• If the learner is not satisfied with the outcome of the formal appeal process, the final stage of the process is an appeal hearing.

• The learner must notify David Lloyd SET Academy of their request for an appeal hearing within 5 working days of receipt of the outcome of their formal appeal.

• Receipt will be confirmed within 10 working days.

• An independent quality assurer external to the company will be contracted by David Lloyd SET Academy within a further 10 working days.

• The independent quality assurer will review the appeal and assessment evidence.

• A panel comprising the independent quality assurer, David Lloyd’s SET Academy Head of Product and Programming and David Lloyd’s Head of Group exercise Operations will discuss the appeal and agree an outcome within a further 20 working days.

• The appeal hearing has a cost of £250 associated with it to cover the cost of the independent quality assurer’s renumeration. This is to be paid in advance by the learner and will be refunded within one calendar month if their appeal is upheld by the panel.

 

Appeal Outcome

Following a successful outcome of an appeal, the learner may have the opportunity to:

• Be reassessed without charge.

• Have their assessment outcome amended as agreed by the independent quality assurer.

• Learners should note that although a successful appeal outcome will result in their result being overturned, this does not guarantee them any work delivering the product within David Lloyd Clubs.
